MEMBERSHIP TERMS AND CONDITIONS

The Parties: This contract is between the member ("customer") and Riaka Fitness LTD - trading as Riaka Reformer Studio.

Minimum Term

By purchasing a membership, the customer agrees to a MINIMUM 12-WEEK TERM. This minimum term excludes any pause periods. A Minimum Obligation Agreement signifies a commitment to maintain payments for the minimum term, after which the agreement will continue indefinitely until terminated by either the customer or Riaka Reformer Studio.

Weekly Payments

Payments will be charged weekly at the agreed membership rate to the debit or credit card on file for the customer through Ezypay. Payments will be processed within 24 hours of the chosen date. If the date falls on a weekend or public holiday, the payment may be processed within 24 hours from the beginning of the next business day.

Failed Payments

If a recurring payment fails on the first attempt, our provider Ezypay will make three additional attempts over the following days, totaling four attempts to collect payment. Riaka Reformer Studio will contact the customer after the first failed payment to request immediate resolution. After the initial failed payment, the customer will not be permitted to use the membership to book classes until a successful payment is made. If a balance remains outstanding for more than four weeks, Riaka Reformer Studio may report the default to credit reporting agencies and may refer the debt to a collection agency.

Changes in Membership Fees

Outside of any minimum term obligation agreed to by the customer, Riaka Reformer Studio may modify membership fees at any time with a four-week notice period.

Membership Pauses

The customer may pause their membership for a maximum of 6 weeks per year, starting from the first day of the membership. Pauses must be for at least one week at a time. Memberships must be active for our system to process the pause. Memberships will not be considered active without full payment up to the date of the pause request. A pause request must be made in writing via email to riakafitness@outlook.com at least one week before the desired pause start date to ensure proper processing. Requests with less than one week’s notice may be denied. The email must specify the start date and duration of the pause. During the pause period, customers will not have access to bookings or facilities covered by the Agreement. Additional pause requests beyond the 6 weeks allocated will only be considered with supporting documentation from a registered professional.

Termination/Changes

To terminate their agreement or change their membership type, customers must do this through the website. Memberships cannot be canceled or downgraded to a lesser value within the fixed term or minimum obligation period. In cases of early cancellation due to extreme or medical circumstances, documentation from a registered professional may be required.

Refunds and Extensions

All memberships are non-refundable and non-transferable between customers. No refunds will be issued, and no extensions will be allowed for the specific valid time frame of class credits.

Bookings

Class bookings are required and must be made through the Riaka Reformer website or the Gymmaster app.

Holiday Closures

If Riaka Reformer Studio chooses to close for holiday periods such as Christmas and New Year, the customer’s membership will be paused for the duration of the closure. This pause will not count towards the maximum 6-week pause allowance per year. Memberships will not be paused for individual public holidays like Anzac Day, Waitangi Day, or Matariki when Riaka Reformer Studio is closed.

Forced Closure

If Riaka Reformer Studio is compelled to close due to government restrictions, customers will be notified via email and given the option to pause their membership in addition to the 6-week pause allocation. The pause will be for the duration of the government-mandated closure. Extensions beyond the mandatory closure period will count toward the 6-week pause allocation (and the 1-week minimum term will apply).
